10.Acceptable Use
These Terms and Conditions form part of the full Terms and Conditions of services
Acceptable use
- Our services cannot be used -
- in any way that is inconsistent with any law, regulation, order from a court of competent jurisdiction, right, code of conduct or practice, this Agreement and guidelines which we may publish from time to time, or in any way that promotes any such activity.
- In any way that breaches a third Party’s Intellectual Property rights and privileges, or in any way that promotes any such activity.
- to host, store, process, distribute, send, link to or otherwise make available any Prohibited Content, Malicious Software, Bad Neighbourhood or denial-of-service attacks.
- to promote or link to Warez, peer to peer and file sharing of copyright protected or illegal material.
- to promote or link to hacking or cracking software.
- engaging in conduct that invades or breaches the privacy of another.
- to spoof the URL, DNS or IP addresses of websites not assigned, registered, owned or controlled by you or Impersonate any person or entity.
- Access or attempt to access another user’s account without his or her consent.
- In the interests of clarity –
- ‘Prohibited Content’ means any material in any format that is illegal, unlawful or otherwise objectionable including but not limited to threatening, harmful, harassing, abusive, malicious, tortious, defamatory, discriminatory, libellous, fraudulent, obscene, vulgar, racist, or related to child pornography, terrorism or criminal activity.
- ‘Malicious Software’ means any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other code or program designed to operate without the knowledge or consent, whether for malicious purposes or not.
- ‘Bad neighbourhood’ means a number of websites linked together in a deceptive, unscrupulous, malicious, manner or for such purposes, which could include (but not limited to) spamming, cloaking or hidden links, plagiarism and banned or illegal websites.
- ‘denial-of-service attacks’ means an attempt to interrupt or prevent legitimate access to a server or network by overloading with repeated calls.
- We have zero tolerance of any abuse of our services or networks, we reserve the right and shall exercise that right to prevent access to, remove or delete any material or the promotion of websites containing such material either temporarily or permanently that we, at our sole discretion is not consistent with our Terms and Conditions, we shall fully co-operate with any authority or investigation that may arise from your use of our services.
- We reserve the right to recover any costs, expenses or losses incurred as a result of any misuse or abuse of our services or networks including but not limited to clean up/repairs to the Hosting Capacity, our servers or software, administration, termination, representations or attendance with authorities, use of third party representation and legal costs.
